Lob Service Specific Terms

- Lob Audience
If the Customer is purchasing a direct mail targeting product (the “Lob Audience Product”) via www.lob.com, the following service-specific terms and conditions apply:
- Lob, or its respective licensor(s), owns all right, title and interest in and to the Lob Audience Product. This includes, without limitation, all design, compilation, information, data, and results elements of the Lob Audience Product. Customer shall not refer to the Lob Audience Product, Lob, or Lob’s respective licensor(s) in any mailing. The Lob Audience Product is provided “AS IS” without warranties of any kind, express or implied.
- Customer is hereby authorized to use the Lob Audience Product only for the specifically contemplated direct mail targeting campaign. Except as otherwise expressly stated herein, nothing in these terms and conditions grants or may be construed to grant Customer any intellectual property rights in or to the Lob Audience Product. Customer’s right to retain the Lob Audience Product shall be determined by Lob and/or its respective licensor(s) on a case by case basis.
- Customer represents and warrants to Lob that (1) Customer’s collection, use, and disclosure of all data disclosed to Lob in connection with a Lob Audience Product does not and will not violate the rights of any third party; and (2) Customer’s collection and use of all data disclosed to Lob in connection with a Lob Audience Product complies with all applicable data protection laws, rules, and regulations; and (3) Customer has made all disclosures and obtained all authorizations necessary for Lob and Lob’s third-party service providers to use and disclose all data disclosed to Lob in connection with a Lob Audience Product.
- Customer is aware Lob and/or the Lob Audience Product may be affected by future requirements implemented by Lob’s respective licensor(s) and/or applicable law. Therefore, Customer hereby agrees to promptly and fully cooperate with Lob to comply with any such future requirements, including, without limitation, executing a written amendment to these terms and conditions.
- All Lob Audience Product purchases are final and nonrefundable. A Lob Audience Product purchase will be available for 180 calendar days from the date of purchase.
- Customer shall not use, or allow the use of, the Lob Audience Product:
- for any illegal purpose or in violation of any local, state, national, or international law;
- to violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right;
- to develop any service or products (including list enhancement or data appending services or products), or to publish or maintain a directory or other compilation of information in any form, including on the public internet;
- for individual look-ups of people or households including, without limitation: (i) skip tracing functions; (ii) electronic directory assistance applications or other e-data looks; (iii) verification of the accuracy of a record; (iv) review of employee records; or (v) any type of review, analysis, or assessment of an individual record that is not expressly permitted hereunder.
- to distribute any content that is fraudulent, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, pornographic, harassing, threatening, hateful, or otherwise inappropriate;
- (1) as a factor in establishing an individual’s credit or insurance eligibility; (2) to evaluate an individual for employment; (3) in connection with a determination of an individual’s eligibility for a license or other benefit granted by a governmental authority; (4) in a way that would cause the Lob Audience Product to constitute a “consumer report” under the FCRA; or (5) in any other manner that would cause such use of the Lob Audience Product to be construed as a consumer report by any authority.
- for the transmission of “junk email”, “spam”, “chain letters”, “phishing” or other unsolicited mass distribution of email;
- sell or otherwise transfer the access granted to the Lob Audience Product by Lob to a third party;
- attempt to do any of the acts described in this subsection, or assist or permit any person in engaging in any of the acts described in this subsection.
- Lob Print and Mail
- Lob does not review or monitor mailpiece content sent by Customer using Lob’s products and services. Lob shall have no liability to Customer or any third party arising from Customer’s mailpiece content. Customer acknowledges and agrees it is Customer’s responsibility to select the mailpiece form factor (e.g. postcard, envelope) appropriate for Customer’s use case and content. Further, Customer acknowledges, understands, and agrees that (1) Lob is required by the USPS to use the National Change of Address (NCOA) service; (2) due to the NCOA service, Customer-provided addresses may be automatically changed; and (3) such changes are outside of Lob’s control and therefore Lob shall not be responsible or liable for such changes.
- Customer (and if applicable, Customer’s end user(s)) must not use Lob products and services to send mailpieces to recipients unless and until Customer (and if applicable, Customer’s end user(s)) has all necessary and required authorizations to do so. If Lob receives a complaint regarding a mailpiece, Lob reserves the right to suspend Customer’s access to Lob’s products and services until such complaint is resolved to Lob’s satisfaction.
- Mail delivery times may vary depending on the location and service selected. Customer understands and agrees that Lob does not control the postal service(s) and ultimately the delivery time will depend on the service provided by the applicable postal service (e.g. USPS). Delivery times may also be impacted by factors such as weather, road conditions, and fuel or labor shortages, which are all outside of Lob’s control.
- If Customer engages Lob for paper check print and mail services (the “Check Service”), Customer acknowledges and agrees Lob’s sole obligation is paper check printing and mailing as instructed by the Customer. Customer is solely responsible for all check-related information provided to Lob, and Lob shall not be liable to Customer, any depositary, payor bank, or any other third party for any checks printed and mailed via the Check Service using information provided by Customer (or on Customer’s behalf) that is incorrect, incomplete, unauthorized, or fraudulent. Neither Lob nor its service provider(s) will screen or verify any check information before, during, or after printing or mailing, including, but not limited to, check amount, account number, routing number, payee name, and check status. The Check Service is not, and must not be used as, a bill payment service. eChecks are not available via the Check Service. Customer further acknowledges and agrees that Customer, and not Lob, is solely responsible for complying with all applicable national, state, regional and local laws governing checks and payments. This includes, but is not limited to, the laws, regulations, and orders promulgated by the U.S. Department of the Treasury (e.g. OFAC and FinCEN). Customer agrees to defend, indemnify, and hold Lob, and Lob’s affiliates, officers, directors, employees, suppliers, consultants, and agents harmless from and against any and all liabilities, losses, damages, claims, or demands (including expenses, court costs, and reasonable attorney’s fees) arising from or related to Customer’s use of the Check Service, use of the Check Service on Customer’s behalf, or use by a third party of the Check Service as made available by Customer to such third party. If Customer makes the Check Service available to a third party as part of a bill payment service, Customer shall require such third party to agree to terms and conditions substantively similar as the foregoing in this subsection.
- Unless otherwise agreed to in a signed agreement between Lob and Customer, Customer agrees that it will not provide to Lob any information or content that is: (a) “consumer credit information” as defined by the Fair Credit Reporting Act, or b) provided by / obtained from a credit bureau (such as Experian, Equifax, or Transunion) or other credit reporting agency. Customer agrees to immediately notify Lob if Customer becomes aware of any suspected or actual sharing of such information with Lob.
- Lob Address Verification
- All data provided by or gathered from use of Lob’s address verification service is considered part of the Lob Services and Customer agrees not to exceed the scope of the license provided by Lob in the applicable services agreement. Address verification is provided for general informational purposes only and Customer agrees that it does not and will not use such service without first obtaining the proper permissions and consents from the address owner(s).
- Lob’s address verification service may provide Customer with deliverability data, including the Lob Confidence Score. The Lob Confidence Score is generated using proprietary Lob technology and Lob reserves all rights in such technology. The Lob Confidence Score is provided for general informational purposes only and does not guarantee deliverability. Customer’s use of the Lob Confidence Score is solely at the risk and discretion of the Customer.
- Lob’s address verification service includes results provided by Lob’s suppliers and all right, title, and interest in and to such results are reserved by Lob or its suppliers, as applicable. Customer is permitted to use data and results obtained via the address verification service only for Customer’s internal business purposes. Customer shall not rent, lease, copy, transfer, resell, sublicense, lease, time-share, or otherwise provide access to the results to any third party.
- USPS Disclaimer and Copyright - Lob is a non-exclusive licensee of the United States Postal Service (“USPS”), and the USPS reserves all rights in and to all such licensed intellectual property. The USPS does not endorse, support, control, approve, or sponsor any of Lob’s products, services, or associated pricing.
- Lob APIs
- If Customer elects to access and/or use a Lob Application Programming Interface (each, the “Lob API”), Customer must ensure (1) only its authorized user(s) access and/or use the Lob API; and (2) each such authorized user can authenticate using a Lob API Key. To use a Lob API, Customer must first obtain a Lob API Key. All API Keys obtained by Customer must be kept strictly confidential and secure. Customer is solely responsible for all activities that occur under its authentication to a Lob API.
- Customer shall adhere to all applicable rate limits established by Lob in either Customer’s order documentation and/or at https://docs.lob.com. Any violation of Lob’s rate limits may result in the immediate suspension and/or termination of Customer’s access to a Lob API.
- In connection with accessing and using the a Lob API, Customer must not and shall not allow, assist, or encourage others to:
- access or use the Lob API in violation of this subsection and/or any applicable federal, state, or local laws or regulations, or in connection with any fraudulent, misleading, threatening, or other harmful purpose or activity;
- violate the intellectual property rights of Lob or any third party;
- engage in any scraping, data mining, or other similar activity, including, without limitation, any product evaluation, benchmarking, or other comparative analysis;
- tamper with, interfere with, disrupt, or damage the Lob API, including, without limitation, making an unreasonable number of API requests;
- access or use the Lob API to build a similar or competitive product and/or service;
- modify, copy, reverse engineer, disassemble, decompile, or make derivative works of any part of the Lob API;
- remove or obscure any proprietary or other notices contained on the Lob API, or misrepresent the source or ownership of the Lob API;
- gain unauthorized access to and/or introduce any virus, worm, trojan horse, or other malicious computer code or instructions into a Lob system or a Lob service provider’s system;
- except as authorized by Lob in writing, incorporate, use, distribute, or provide the Lob API, including any portion thereof, with any website, product, service, or other similar offering; or
- access or use the Lob API for any purpose other than to use Lob’s products and services, including, without limitation, to rent, lease, copy, resell, time-share, or otherwise provide access to the Lob API to any third party.
- Customer represents and warrants to Lob that (1) all Customer website(s), product(s), service(s), or other similar offering(s) that access and/or use the Lob API comply with all applicable data protection laws, rules, and regulations; (2) Customer has made all disclosures and obtained all authorizations necessary for Lob and Lob’s third-party service providers to use and disclose all information shared with Lob via the Lob API; and (3) users of all Customer website(s), product(s), service(s), or other similar offering(s) that access and/or use the Lob API have agreed to terms and conditions substantively the same as those contained herein.
- Customer hereby agrees to defend (at Lob’s option), indemnify, and hold harmless Lob from and against any and all liabilities, losses, damages, claims or demands (including court costs and reasonable attorney’s fees) asserted against or incurred by Lob as a direct or indirect result of Customer accessing and/or using the Lob API.
- Third-Party Integrations or Connectors
- From time to time, Lob may offer Customer the opportunity to access and use an integration with a third-party product or service (each, the “Third Party Integration”). To use a Third Party Integration, Customer must have an active customer account with Lob and with the third-party that owns and operates the product or service that Customer integrates with.
- Customer’s access and use of the Third Party Integration is at Customer’s own risk, and Customer is solely responsible for implementation of the Third Party Integration, including, without limitation, ensuring Customer has made all disclosures and obtained all authorizations necessary for Lob and the third-party service provider to use and disclose all information shared via the Third Party Integration.
- Lob is not responsible for the third-party products or services that Customer integrates with and Lob has not reviewed the terms and conditions (including any privacy policy) associated with such products and services. Lob encourages Customer to carefully review all such terms and conditions (including any privacy policy) before accessing and using a Third Party Integration.
- Customer hereby agrees to defend (at Lob’s option), indemnify, and hold harmless Lob from and against any and all liabilities, losses, damages, claims or demands (including court costs and reasonable attorney’s fees) asserted against or incurred by Lob as a direct or indirect result of Customer accessing and/or using the Third Party Integration.
